Any business or property owner occupying or using the public way is required to obtain a public way use permit. The most usual of these encroachments are signs, canopies and lights. Public way use permits are issued by the Department of Business Affairs and Consumer Protection (DBACP) and are valid for five years.
Before bringing your public way use application or renewal to the 45th Ward office for Alderman Arena’s signature, please make sure you have filled in the worksheet and drawing with all of the required measurements. Please also include a photo of the location that you intend to use the public way. DBACP may not process your application unless it is complete.
After Alderman Arena approves your public way use application, it must be taken to DBACP’s Public Way Use Unit. The diagram below explains the entire City Council process. There is an annual fee for the permit and general liability insurance will need to be provided after City Council approval and each year afterward.
The Department of Buildings also requires a permit to be obtained for the installation of all signs, awnings and canopies. For more information on how to obtain a this permit, please click here.
